5. Spam Protection and Security Services

Google reCAPTCHA
We use Google reCAPTCHA (provided by Google Ireland Limited) to protect our forms from spam and abuse. This service analyses user behaviour to distinguish humans from bots. For this purpose, personal data such as IP address, mouse movements, and interaction behaviour may be processed.
The processing is based on our legitimate interest in protecting our website (Art. 6(1)(f) GDPR).
Data may be transferred to the USA. Google relies on appropriate safeguards such as Standard Contractual Clauses (SCCs) approved by the European Commission and/or the EU–US Data Privacy Framework.

• Pre-contractual measures — Art. 6(1)(b) GDPR: Processing for the performance of
pre-contractual measures taken at the request of the data subject. This legal basis
applies when you submit a consultation request form: by doing so, you initiate a pre-contractual relationship, and we process your personal data in order to evaluate and respond to your inquiry prior to the conclusion of any potential agreement. (Original German wording: Art. 6 Abs. 1 lit. b DSGVO – „Verarbeitung zur Durchführung vorvertraglicher Maßnahmen“)
• Legitimate interests — Art. 6(1)(f) GDPR: For website security, system maintenance, publishing blog comments, spam protection via reCAPTCHA, and service improvement
— where our legitimate interests are not overridden by your fundamental rights and freedoms.
• Legal obligation — Art. 6(1)(c) GDPR: Where we are required to process data to comply with applicable Austrian or EU law.

8. External Platforms and Third-Party Links

Our website may display icons or links to external social media platforms and other third-party services. When you click on such an icon or link, you will be redirected to the respective external platform or website.
Please be aware of the following:
• Once you leave www.stellar-v.com, this privacy policy no longer applies.
• We have no control over, and are not responsible for, the data collection, storage, or processing practices of any external platform or third-party website.
• The operators and owners of those external platforms are solely and independently responsible for the personal data they collect and process from you.
• Your data will be governed exclusively by the privacy policy of the respective third-party platform — not this policy.

Stellar V GmbH accepts no liability for the data processing activities carried out by third-party platforms, regardless of whether you accessed them via an icon or link displayed on our website.

9. Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, in accordance with applicable Austrian and EU law:
• Newsletter subscription data (email, subscription date): retained until you unsubscribe or request deletion
• Consultation request data (name, company, email, message): retained for the duration of our business relationship and as required by applicable legal obligations (e.g. up to 7 years under Austrian commercial and tax law — § 132 BAO / § 212 UGB)
• Blog comment data (name, email, comment content, timestamp): retained for as long as the blog post remains published, or until you request deletion
• System logs and technical data: retained for a maximum of 30 days
Once the applicable retention period expires, your personal data will be securely deleted or anonymized in compliance with Art. 5(1)(e) GDPR (storage limitation).

10. Data Security

We implement appropriate technical and organizational measures (TOMs) to protect your personal data against unauthorized access, disclosure, alteration, or destruction, in accordance with Art. 32 GDPR. Processing is carried out using secure IT systems following strict internal procedures. Only authorized personnel or contracted service providers with a demonstrable need have access to your data.

11. Your Rights Under the GDPR (DSGVO)

As a data subject in the European Union, you have the following rights under the GDPR, which are directly applicable in Austria and complemented by the Austrian Data Protection Act (Datenschutzgesetz – DSG):
• Right of access (Art. 15 GDPR / § 1 DSG): You may request a copy of the personal data

• Right to rectification (Art. 16 GDPR): You may ask us to correct inaccurate or incomplete data.

12. Legal Action and Compliance

Your personal data may be used by Stellar V GmbH for legal purposes in court proceedings or in the preliminary stages of potential legal action arising from misuse of our website or services.
We may be required to disclose personal data upon a lawful request by Austrian courts or public authorities in accordance with applicable law.
